Changing inherited property ownership step-by-step Spain 2026

Procedures to change ownership of an inherited property in Spain: inheritance acceptance, Inheritance Tax, Plusvalía Municipal, deed, registration. Deadlines and costs 2026.

When you inherit a property, you’re not the owner until you officially change ownership. Without this step, you can’t sell, mortgage, or do significant transactions.

The four process stages

1. DOCUMENT collection → 2-4 weeks
2. INHERITANCE ACCEPTANCE → 1 visit (~2 hours)
3. INHERITANCE TAX → 6 months max
4. PROPERTY REGISTRY filing → 15-30 days

Stage 1: documents

From deceased:

  • Death certificate (€3-5)
  • Last wishes certificate (€3-5)
  • Testament copy (€30-60)
  • Life Insurance Registry certificate (free)
  • If no testament: heir declaration before notary (€700-1,200)

From property:

  • Property deed
  • Updated registry note (€5-9 online)
  • Latest IBI receipt
  • Cadastral certificate (free)

From heirs: DNI/NIE of all heirs.

Stage 2: inheritance acceptance

The inheritance acceptance and partition deed is signed before notary.

Who attends: all heirs (or representatives with notarial power).

Cost: €600-1,500.

Stage 3: tax liquidation

Inheritance Tax

Deadline: 6 months from death. Valencia: 99% exemption descendants, spouses, ascendants. Real fees usually €100-500.

Plusvalía Municipal

Deadline: 6 months. Amount: €1,000-3,500.

IRPF (not paid on inheriting)

Stage 4: Property Registry inscription

Cost: €300-600. Deadline: 15-30 days for registrar to inscribe.

Total costs typical case

Property inherited from parents by two children in Sueca, valued €150,000:

ConceptCost
Various certificates€30
Inheritance acceptance€800
Agency€600
Inheritance Tax (99% exempt)€200
Plusvalía Municipal€2,000
Property Registry€350
Total€3,980

Common mistakes

1. Missing Inheritance Tax deadlines. 5-20% surcharges + interest. 2. Not updating ownership quickly. If heirs want to sell but haven’t changed ownership, can’t. 3. Doing acceptance but not registry inscription. Have deed but Registry still shows deceased. 4. Heir disagreement delaying everything. Sometimes one heir won’t sign.

And if I want to sell the inherited property

Process: first change ownership, then sell. Selling without regularised ownership is legally impossible.

At INSA, when working with heirs, we can:

  • Begin valuation in parallel with inheritance procedures
  • Coordinate with notary and agency to accelerate
  • Begin buyer search as soon as acceptance is signed
  • Close sale immediately after registry inscription

This reduces total time from death to sale from 6-9 months to 4-5 months.

Frequently asked questions

How long to change inherited property ownership?
Complete process from death to registry inscription typically takes 3-9 months. Notarial procedures are quickest (1 month); slowest is liquidating Inheritance Tax (6-month legal deadline, extendible). Well organised: 4 months. With heir disagreement: years.
How much does it cost?
For inheritance between spouses or parents-children in Valencia: notary €700-1,500, agency €400-800, Plusvalía Municipal €1,000-3,500, Inheritance Tax symbolic (99% exemption descendants/spouses) €100-500. Total: €2,500-6,500.

What documents do I need?
Death certificate, certificate of last wishes, authorised testament copy (or heir declaration if no testament), Life Insurance Registry certificate, deceased's property deed, latest IBI, cadastral certificate, all heirs' DNI/NIE.
