When you inherit a property, you’re not the owner until you officially change ownership. Without this step, you can’t sell, mortgage, or do significant transactions.
The four process stages
1. DOCUMENT collection → 2-4 weeks
2. INHERITANCE ACCEPTANCE → 1 visit (~2 hours)
3. INHERITANCE TAX → 6 months max
4. PROPERTY REGISTRY filing → 15-30 days
Stage 1: documents
From deceased:
- Death certificate (€3-5)
- Last wishes certificate (€3-5)
- Testament copy (€30-60)
- Life Insurance Registry certificate (free)
- If no testament: heir declaration before notary (€700-1,200)
From property:
- Property deed
- Updated registry note (€5-9 online)
- Latest IBI receipt
- Cadastral certificate (free)
From heirs: DNI/NIE of all heirs.
Stage 2: inheritance acceptance
The inheritance acceptance and partition deed is signed before notary.
Who attends: all heirs (or representatives with notarial power).
Cost: €600-1,500.
Stage 3: tax liquidation
Inheritance Tax
Deadline: 6 months from death. Valencia: 99% exemption descendants, spouses, ascendants. Real fees usually €100-500.
Plusvalía Municipal
Deadline: 6 months. Amount: €1,000-3,500.
IRPF (not paid on inheriting)
Stage 4: Property Registry inscription
Cost: €300-600. Deadline: 15-30 days for registrar to inscribe.

Common mistakes
1. Missing Inheritance Tax deadlines. 5-20% surcharges + interest. 2. Not updating ownership quickly. If heirs want to sell but haven’t changed ownership, can’t. 3. Doing acceptance but not registry inscription. Have deed but Registry still shows deceased. 4. Heir disagreement delaying everything. Sometimes one heir won’t sign.
